4 We recommend to read carefully all the purchase terms and conditions before enter to the "Old Stock and Samples Shop".

  PURCHASE TERMS AND CONDITIONS:
4All purchases made in the shop are subject to the general conditions laid out in this document:
PRODUCTS ON SALE. The products available in the shop are:
- Old seasons stock
- Old seasons samples
- Boreal equipment: different kind of products like huts, t-shirt, back-bags, gaiters, chalk-bags, etc.

4PURCHASE SYSTEM:
European Union:
-There is no minimum or maximum limit of purchase.
Rest of countries:
- In any case it will be possible to buy more than one article in the same purchase. If a client desires to acquire more than one product it must be done in two different orders. This measure is not applied to "Boreal Equipment", which could be acquired join with an article of the others ranges of products.

4PRICE LIST:
-Articles prizes in the shop are quoted without tax. The tax will vary according to the country from where you purchase. It will be specified in the moment of making the order.
All the articles are valued in Euros - € - , being this currency the only one accepted in the shop.

4PAYMENT SYSTEM:
- Spain (include Baleares, Canarias, Ceuta and Melilla)
The payment system is cash on delivery. The purchase has to be paid in the moment of receiving the delivery. We will inform the client the date of the delivery of the article in the definitive order confirmation(*).
- In all the countries with the exception of Spain
1) Bank transfer. The bank account where the payment has to be done will be provided in the order confirmation. We do not consider a formal order until the bank transfer is in our account and it is communicated to us. In that moment we will send an e-mail with the definitive order confirmation(*), where we will inform the client that the bank transfer has been notified to us and the date of delivery of the merchandise.

2) Credit card. Ones the payment has been validated we will send an e-mail confirmation(*), where we will inform the client that the payment has been notified to us and the date of delivery of the merchandise.

(*) We recommend to keep it, at least during the time of effect of the guarantee, because it will be a complaint requirement.

4PURCHASE RECEIPT
At the same moment the order will be delivered we will send the purchase receipt through e-mail(*)

4DELIVERY SYSTEM AND DELIVERY TIME::
- Deliveries to Spain:
The shipment will be made through Correos y Telégrafos. The cost of the delivery depends on the cost of the shipment and the cost of the payment through cash on delivery.
In the case of the cost of the shipment the cost will be shown during the order confirmation process.
The cost due to the cash on delivery depends on Correos price list. On 1st January 2002 Correos had the following price list in order to calculate the cost of the cash on delivery:

· Fixed charges: 1.29 €
· Variable charges: 0.007 * Final cost of the goods (cost of the goods + cost of the shipment)

The result of calculating the cost of the cash on delivery will be an approximate quantity because Correos reserve the right to modify the price list.

The delivery deadline is approximately between 4 and 8 days (since the date of the order confirmation), in accordance with the terms established by Correos and Telégrafos.
By reasons beyond our control these periods of time could be different, it will be by internal causes of the transports company or by force mayour reasons.

- Deliveries to all the countries with the exeption of Spain:
The shipment will be done through DHL ( www.dhl.com ), which has a parcel tracking service based on a code for each order. This code will be attached in the e-mail of definitive order confirmation. The cost of the delivery depends on the country where the order has to be sent and the weight of the goods, which will be notified during the purchase process.

The delivery deadline established by DHL is between 1 and 5 days (since the date of the order confirmation) depending on the country of delivery.
By reasons beyond our control these periods of time could be different, it will be by internal causes of the transports company or by force mayour reasons.

 

4GUARANTEE AND POST-SALES SERVICE:
The clients of this shop will have the same guarantee than the rest of the clients of Boreal. The products of mountaineering, trekking and walking ranges have a one year guarantee and the products of the climbing range have a six months guarantee.

In the case of appearance of a manufacture defect or a damage of the raw materials the client have to:
1) Send the product to the attention of the Boreal Post-Sales Service join with a copy of the definitive order confirmation, a copy of the purchase receipt and a explanation of the complaint reasons to the following address:

Besides the client has to include an e-mail contact.

- The transport cost has to be paid by the client -

2) Our Post-Sales Service will analyse the causes of the complaint in the laboratory. Once determined the causes of the problem we will proceed in the following way:

- If the client is right and there is a real problem in the article we will repair it(**)
- In the case it can not be repair we will change the article for a new one(*) (**).
- In the case we were out of stock of the article and the exchange could not be done(*) we would get in touch with the client through e-mail in order to request a bank account where we could pay the cost of the article.

In all cases, we will make an economical compensation to the client paying for the delivery costs of the client. This amount of money will be the ones that appear in the purchase receipt. We will get in touch with the client through e-mail in order to apply a bank account where make the transfer of the amount.

(*) In these two cases the product sent by the client to Boreal will not be returned. The product will end in possession of Post-Sales Service in order to improve the service of Boreal to the clients.
(**) In this two cases the shipment will be paid by Boreal

- If the complaint were not appropriate by any reason determined by the laboratory like end of life of the product, expired guarantee or not right use of the article, the article will be return to the client. The charges of this shipment will be paid by Boreal.

In all the cases the client will receive provided with the return article a letter written by our Post-Sales Service explaining the result of the research.

In the case we didn't return the article to the client due to a money return we will send the laboratory letter by e-mail.

4RETURN OR CHANGE OF MERCHANDISE:
We will not accept under any circumstance returns of material unless it were due to the inappropriate conditions of the material or by a mistake in the shipment of the goods.
The transport in all the cases will be paid by the client.

If the client requests an exchange of size it have to be notified to:

Once received the e-mail we will answer following these two steps:

- If the model and size requested is in stock we will inform the client of it through e-mail and we will apply for the shipment of the article purchased to our factory. At the same time we will inform of the cost of the transport and the bank account where the client will have to make the payment of this cost. Ones received the article purchase and our bank informs us that the payment is done, we will get in touch with the client to inform the date of departure of the article from the factory.

- It the model and size is out of stock we will get in touch with the client in order to offer the option of choose other model of the shop. The price of this model can not be higher of the money paid for the initial purchase. In the case the price were higher we will inform of the difference of cost and the bank account where it will have to be paid. Anyway, we will inform of the cost of the transport that will have to be paid through a bank transfer as well. Ones our bank informs us that the payment is done we will get in touch with the client to inform the date of departure of the article from the factory.

4DISCLAIMER:
Climbing, trekking and mountaineering are all intrinsically dangerous and could result in serious injure. It is responsibility of the client to be technically competent to use the materials available in our shop.

4PERSONAL DATA PROTECTION:
All personal information provided by the clients will be included in the Date Base of the Boreal Old Seasons Models and Samples Shop. In no case the information of this Data Base will be provided to an external company in order to assure the total confidentiality of our clients.

4BOREAL CLUB
Any client who wish to join BOREAL CLUB must send by an e-mail to notinseason@e-boreal.com informing us the intention of being a member of the club. Attached to the e-mail it will be indispensable to send the definitive confirmation order and the purchase receipt.

The e-mail must be sent within 30 days of the purchase receipt date.

      Boreal reserves the right to modify in part or as a whole the terms and conditions exposed in this document.
